When a married couple with children gets divorced, there are certain legal issues that need to be  addressed. The same is often true when two unmarried people have children and decide to live separately. These issues include child custody, child support, and visitation.

Child custody arrangements involve both legal and physical custody. Legal custody involves the ability to make important decisions about the way a child is raised, such as decisions about education, religion, and healthcare. Physical custody, on the other hand, addresses with whom a child will live and for how long.

Child support payments are court-ordered payments that a non-custodial parent pays to the custodial parent. The policy idea behind child support is that parents who live apart should have the same level of support they would have if they lived together. While courts have discretion in awarding child custody, they typically use a formula based on the parents’ incomes, spousal support payments, daycare expenses, and health insurance costs.

Under Virginia law, parents who do not have primary physical custody of a child have the right to visitation. A parent can lose their right to visitation if a judge determines that visitation is not in the best interest of the child. In many cases, the parents themselves work out a visitation schedule. In cases where the parents cannot reach an agreement, a court will establish a visitation schedule.
